Welcome to StashCo Cannabis (“StashCo,” “we,” “our,” or “us”). This website is operated in compliance with California cannabis law. By accessing or using www.stashcocannabis.com (the “Site”) or placing an order, you (“you,” “your,” or “Customer”) agree to be bound by the following Terms & Conditions (“Terms”).

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THIS SITE OR OUR SERVICES.

1. Legal Use & Eligibility

You must be 21 years of age or older, possess valid government-issued photo identification, and reside in a jurisdiction where cannabis delivery is permitted under California law.

By accessing our Site, creating an account, or placing an order, you affirm under penalty of perjury that:

  • You are at least 21 years old
  • The information you provide is true and accurate
  • You are legally authorized to purchase, possess, and consume cannabis in California

We reserve the right to refuse or cancel service at any time for any reason, including suspected fraud, age misrepresentation, or delivery to prohibited areas.

2. State Compliance Notice

StashCo Cannabis operates solely within the State of California under licenses, ordinances, and regulations established by the Department of Cannabis Control (DCC). We do not ship or deliver cannabis across state lines.

All transactions are subject to applicable state, city, and county taxes, including:

  • Cannabis Excise Tax 
  • State Sales Tax
  • Local Cannabis Business Taxes (e.g., Sacramento city tax)

3. Account Registration

You may be required to create an account to access certain features or place orders. You are solely responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity under your account
  • Immediately reporting unauthorized access to us

StashCo reserves the right to suspend or terminate accounts suspected of fraudulent or abusive behavior.

4. Order Acceptance, Verification & Delivery

A. Verification

Before delivery, we are legally required to verify your:

  • Government-issued ID
  • Age (21+)
  • Match between name, ID, and order

Your ID will be scanned or photographed at time of delivery and stored in accordance with DCC regulations.

B. Delivery Policy

  • You must be physically present with your ID to receive an order
  • Products cannot be delivered to a different person or alternate address after checkout
  • Orders not completed due to failed verification or absence may incur a restocking fee up to 30%

If you are intoxicated, hostile, or otherwise unfit to receive cannabis, delivery will be refused and no refund will be issued.

5. Payment Terms

We accept cash and debit card transactions at the time of delivery. Charges will reflect cannabis excise taxes, state/local sales tax, and regulatory surcharges where applicable.

Prices are subject to change without notice and are not guaranteed until checkout is completed. We reserve the right to cancel or adjust orders in the event of errors, inventory issues, or non-compliance.

6. All Sales Final – No Returns

Under California law, cannabis sales are final and may not be returned. This includes flower, pre-rolls, concentrates, edibles, tinctures, and merchandise.

If your product is defective, damaged, or incorrect, please contact us within 24 hours of delivery with photos and order details. We may issue a store credit or replacement at our sole discretion.

7. Risk Assumption & Limitation of Liability

By purchasing cannabis products from StashCo, you acknowledge the following:

  • Cannabis affects individuals differently
  • You assume full responsibility for consumption, dosage, and side effects
  • You understand cannabis may impair judgment, coordination, and cognitive function
  • You agree not to operate vehicles or machinery under the influence

To the fullest extent permitted by law, StashCo disclaims all liability for:

  • Personal injury
  • Adverse health outcomes
  • Improper storage or use of cannabis
  • Inability to complete delivery due to user error or absence

You agree to indemnify and hold StashCo harmless against all claims, damages, losses, or liabilities arising from your misuse of products or violation of these Terms.

8. Prohibited Conduct

You may not:

  • Provide false identification or order on behalf of someone else
  • Attempt delivery to a minor or unverified individual
  • Resell or distribute products in violation of California law
  • Interfere with the Site’s functionality or attempt to access our systems unlawfully

9. Intellectual Property

All content, logos, brand names, images, and product descriptions on this Site are the property of StashCo Cannabis or its partners. Unauthorized use, reproduction, or redistribution is strictly prohibited.

10. Data Use & Privacy

Your personal data is collected in accordance with our Privacy Policy. This includes:

  • ID verification
  • Order tracking
  • Regulatory audit logs

By using our Site, you consent to this data collection and our use of third-party services to process transactions, marketing (if opted in), and compliance requirements.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of California. Any disputes shall be resolved exclusively in the courts of Sacramento County, CA.

12. Modifications to Terms

We reserve the right to update or change these Terms at any time. Continued use of our Site or services after changes are posted constitutes acceptance of those changes.
